The Expat Tours
GENERAL TERMS/CONDITIONS OF SALE
Applicable date from 01/01/2023
Please read the following General Conditions of Sales carefully before booking a tour with The Expat Tours. These conditions outline the rights and obligations of both the tour operator and the customer. By making a booking with us, you acknowledge that you have read, understood, and agreed to these conditions.
Price
The prices of the goods sold are those in force on the day of the order. They are denominated in euro and calculated exclusive of tax. Consequently, they will be increased by the VAT rate and transport costs applicable on the day of the order.
The Expat Tours grants itself the right to modify its rates at any time. However, it undertakes to invoice the goods ordered at the prices indicated when registering the order.
Rebates
The proposed rates include the discounts and rebates that The Expat Tours would have to be granted in view of its results or the assumption by the purchaser of certain services.
Terms of payment
The payment of orders is made:
- either by cheque;
- either by credit card;
- Bank Transfer.
Payments will be made before service
or in Cases of Partial Payment – 7 days at most after Service.
Late payment
In case of total or partial non-payment of the goods delivered on the due date, the buyer must pay The Expat Tours a late payment penalty equal to three times the legal interest rate.
The legal interest rate retained is that in force on the day of delivery of the goods.
As of 1 January 2015, the legal interest rate will be revised every 6 months (Ordinance No. 2014-947 of 20 August 2014).
This penalty is calculated on the amount including VAT of the amount remaining due, and runs from the due date of the price without any prior formal notice being necessary.
In addition to compensation for late payment, any sum, including the deposit, not paid on its due date will automatically produce the payment of a lump sum compensation of 40 euros due for recovery costs.
Articles 441-10 and D. 441-5 of the French Commercial Code.
Termination clause
If within Seven days of the implementation of the “Late payment” clause, the buyer has not paid the sums remaining due, the sale will be automatically resolved and may give right to the allocation of damages for the benefit of The Expat Tours.
Retention of title clause
The Expat Tours retains ownership of the goods sold until full payment of the price, in principal and accessories. As such, if the buyer is the subject of a receivership or liquidation, The Expat Tours reserves the right to claim, in the context of insolvency proceedings, the goods sold and remained unpaid.
Delivery
Delivery is made:
- either by the direct delivery of the goods to the buyer;
- either by sending a notice of availability in store to the attention of the buyer;
- or by depositing the goods at the place indicated by the buyer on the order form.
The delivery time indicated when registering the order is given for information purposes only and is in no way guaranteed.
Consequently, any reasonable delay in the delivery of the products will not give rise to the benefit of the buyer to:
- the award of damages;
- cancellation of the order.
The risk of transport is borne in full by the buyer.
In case of missing or damaged goods during transport, the buyer must make all necessary reservations on the order form upon receipt of the said goods. These reservations must also be confirmed in writing within five days of delivery, by registered letter of receipt addressed to the company.
Force majeure
The responsibility of The Expat Tours may not be implemented if the non-performance or delay in the performance of one of its obligations described in these general conditions of sale results from a case of force majeure. As such, force majeure means any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.
Competent court
Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law.
In the absence of an amicable resolution, the dispute will be brought before the Commercial Court- Tribunal de Paris.
Safety
Professional Guides: Our tours are led by professional and knowledgeable guides who prioritize your safety and well-being. They will provide guidance, assistance, and necessary safety information throughout the tour.
Risk Assessments: We conduct thorough risk assessments of our tour destinations and activities to identify and mitigate potential safety hazards. We adhere to local regulations and industry best practices to ensure your safety during the tour.
Emergency Preparedness: We maintain emergency response plans and procedures to address potential emergencies or unexpected situations during the tour.
This Safe Space Policy helps us make sure The Expat Tours is an inviting and inclusive environment for all who participate in our tours. We encourage everyone — staff and guests — to be proactive in creating an environment where the safety of others is protected. Abuse, harassment, sexual assault, and discrimination is not tolerated.
Anyone participating in one of our tours and/or communicating with our customer service personnel is asked to be aware of their language and behaviour and avoid harmful behaviour. We define “harmful behaviour” as any action that demeans, marginalizes, rejects, threatens, or harms anyone on the basis of ability, age, cultural background, ethnicity, gender, physical appearance, race, religion, self-expression, or sexual orientation.
We ask everyone, whether on our tours or communicating with the company, to abide by the following guidelines:
- Respect peoples’ opinions, beliefs, experiences, and differing points of view.
- Respect everyone’s identity and background (and don’t assume anyone’s background, status or identity).
- Communicate in a respectful manner with all staff, personnel and fellow guests.
- Be responsible for your own actions and be aware that your actions have an effect on others, despite what your intentions may be.
- Be willing to listen and change your behaviour if someone tells you that your actions are making them uncomfortable.
All staff are empowered to enforce these rules. If anyone on the tour and/or in communication with the company can’t abide by the guidelines above, we reserve the right to ask them to leave and/or disengage with them online.
All participants are required to abide by these rules. Anyone attending the tour and/or in communication with the company unable to follow the guidelines above, will be asked to leave the tour and/or conversation without refund. Anyone engaging in behaviour deemed abusive or dangerous will be reported to the appropriate authorities.
Guests are able to be accompanied by their service animals on our walking tours. Our tours are compliant with all local, state and municipal regulations.
